Distance Sales Agreement

This Distance Sales Agreement ("Agreement") is concluded electronically between BNM FABRİKA BİYO NANO MİKRO TEKNOLOJİ SANAYİ VE TİCARET LİMİTED ŞİRKETİ ("Seller") and the customer who accepts it at checkout ("Buyer"), under Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.
1. Parties
Seller: BNM FABRİKA BİYO NANO MİKRO TEKNOLOJİ SANAYİ VE TİCARET LİMİTED ŞİRKETİ, Kaleiçi Mah. Piyale Sk. Meryem Yıldız Sitesi No: 8C, Çatalca, İstanbul, MERSIS no. 0178070122100010, info@dichoptix.com.
Buyer: the account holder who places the order at checkout. The Buyer's name and email are those held on the Dichoptix account and recorded with the order.
2. Subject
The subject of this Agreement is the sale of the Dichoptix subscription selected by the Buyer at checkout, including any therapy hardware the chosen plan carries, and the rights and obligations of the parties under Law No. 6502 and the Regulation on Distance Contracts. The Buyer confirms having read the Preliminary Information Form before accepting this Agreement.
3. Service, plan, and price
The plan, subscription period, and total price including VAT are those displayed at checkout at the moment of the order and are recorded on the order. Included hardware (red-blue therapy glasses or the Dichoptix kit, depending on the plan) is provided at no additional charge and ships only at the Buyer's request.
4. Formation of the contract
This Agreement is formed when the Buyer accepts it together with the Preliminary Information Form at checkout and the payment is confirmed. The acceptance moment is recorded electronically with the order and kept by the Seller as evidence.
5. Performance and delivery
Digital access to the Service begins immediately upon payment confirmation. Hardware, where included and requested, is dispatched by courier to the address the Buyer provides, promptly and in any case within thirty days of the request; risk passes to the Buyer on delivery.
6. Payment and renewals
Payment is made by payment card through the Seller's payment provider PayTR; card details pass directly from the Buyer's browser to PayTR. On the monthly plan the Buyer expressly consents to recurring charges: the subscription renews automatically each month at the then-current price, charged to the stored card, until the Buyer turns renewal off on the subscription page. The Seller sends a reminder before each renewal charge.
If a renewal charge fails, access continues for a short grace period while the charge is retried; if payment cannot be collected, the subscription ends at the close of that grace period without further obligation for future periods.
7. Right of withdrawal
The Buyer normally has the right to withdraw from this Agreement within 14 days without giving a reason, by a clear statement to info@dichoptix.com.
As stated in the Preliminary Information Form, the subscription is a service whose performance begins immediately with the Buyer's express approval given at checkout; once performance has begun, the right of withdrawal for the service is lost in line with Article 15 of the Regulation on Distance Contracts.
For delivered hardware, the Buyer may withdraw within 14 days of receipt provided it is unused and undamaged. As included hardware carries no separate charge, its return alone does not change the price paid; where the Buyer validly withdraws from the contract as a whole, the Seller may request the return of hardware already delivered.
8. Defects
For defective hardware, the Buyer holds the statutory rights under Law No. 6502, including repair, replacement, or, where the law provides, a price reduction or refund. For any defect in the digital service, the Buyer may contact info@dichoptix.com; the Seller will remedy legitimate defects within a reasonable time.
9. Buyer's declarations
The Buyer declares being at least 18 years old, providing accurate information, and having read the Preliminary Information Form, the Terms of Use, and the Privacy Policy, which continue to apply to the use of the Service alongside this Agreement. Personal data is processed as described in the Privacy Policy, in accordance with Turkish data-protection law (KVKK).
10. Disputes and governing law
This Agreement is governed by the laws of the Republic of Türkiye. Disputes may be brought before the Consumer Arbitration Boards within the monetary limits announced each year, or the Consumer Courts, in the Buyer's place of residence or where the transaction was made. Nothing in this Agreement limits the Buyer's mandatory statutory rights.
